C&rsquo;est faux car un accord verbal entre vendeur et acqu\u00e9reur est suffisant. Par contre si une des parties conteste par la suite par exemples la hauteur du bouquet ou la vente elle-m\u00eame&#8230;sans un \u00e9crit, il sera plus difficile de faire valoir son bon droit. Un \u00e9crit est recommand\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Offre d&rsquo;achat<\/h3>\n\n\n\n<p>Il s&rsquo;agit d&rsquo;un document d&rsquo;habitude \u00e9tabli par le conseiller en viager. Il doit reprendre la date, les r\u00e9f\u00e9rences de l&rsquo;immeuble, l&rsquo;identit\u00e9 des parties, les conditions financi\u00e8res (bouquet, rente, dur\u00e9e), la dur\u00e9e de validit\u00e9 de l&rsquo;offre, &#8230; et la signature des parties.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Compromis de vente<\/h3>\n\n\n\n<p>Il peut \u00eatre r\u00e9dig\u00e9 par le conseiller en viager  (sous seing priv\u00e9)ou par le notaire du vendeur (notari\u00e9), juridiquement cela ne change pas grand chose. Pratiquement la signature d&rsquo;un compromis notari\u00e9 demande plus de temps car il faut prendre rendez-vous avec les notaires. Si le compromis est sous seing priv\u00e9 il est simplement sign\u00e9 chez le vendeur.<\/p>\n\n\n\n<p>Jadis un compromis faisait 2 ou 3 pages. Aujourd&rsquo;hui on peut compter une vingtaine de pages. Le document est fouill\u00e9 et souvent ardu \u00e0 comprendre mais il pr\u00e9figure \u00e0 99 % ce que sera l&rsquo;acte notari\u00e9. Sachant qu&rsquo;il faut rassembler plusieurs documents (ex : PEB, documents cadastraux, attestation de sols, etc), il faut compter une quizaine de jours pour qu&rsquo;eil soit \u00e9tabli.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Acte notari\u00e9<\/h3>\n\n\n\n<p>En viager, le notaire du vendeur est charg\u00e9 d&rsquo;\u00e9tablir le projet d&rsquo;acte. Il le transmet ensuite \u00e0 son confr\u00e8re ainsi qu&rsquo;aux parties, pour remarques. Le d\u00e9lai maximum pour signer l&rsquo;acte notari\u00e9 est de 4 mois apr\u00e8s le compromis. En viager les d\u00e9lais peuvent \u00eatre raccourcis \u00e0 environs 2 mois.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>Chacune des trois premi\u00e8res \u00e9tapes cit\u00e9es ci-dessus n\u2019est pas n\u00e9cessairement une \u00e9tape obligatoire.
